Section 5 · Intellectual property rights declaration

1. Ownership of IP

All intellectual property created, developed, conceived, or produced by participants in connection with the Hackathon — including but not limited to software code, algorithms, models, design artefacts, architecture documents, wireframes, prototypes, test cases, datasets, deployment scripts, and any other written or digital output (collectively, "Hackathon IP") — shall be the sole and exclusive property of Ensylon India Private Limited ("Ensylon") from the moment of creation.

2. Assignment of Rights

Participants hereby irrevocably assign to Ensylon all rights, title, and interest in and to the Hackathon IP, including all associated intellectual property rights (copyright, patent rights, trade secret rights, and moral rights, to the fullest extent permitted by applicable law). This assignment takes effect automatically upon creation and requires no further act or agreement.

3. Copyright

Ensylon holds full copyright over all Hackathon IP. Participants may not reproduce, distribute, publish, sublicense, sell, adapt, display, transmit, or otherwise use any Hackathon IP — in whole or in part — for any purpose, commercial or otherwise, without the prior written consent of Ensylon.

4. No Reuse or Disclosure

Participants agree not to incorporate, replicate, or repurpose any Hackathon IP in their own products, services, open-source projects, or publications. Participants further agree not to disclose any proprietary information shared by Ensylon during the Hackathon to any third party.

5. Pre-existing IP

Only generally available open-source software with permissive licences (MIT, Apache 2.0, or equivalent) may be used. Any modification, extension, or integration of such tools produced during the Hackathon shall be considered Hackathon IP belonging to Ensylon. All third-party libraries used must be declared at registration.

6. Representations

Each participant represents that they have the authority to agree to these terms, that participation does not violate any agreement with their current employer, and that no Hackathon IP will infringe any third-party intellectual property rights.

Section 6 · Health, safety and liability waiver

1. Voluntary Participation

Participation is entirely voluntary. Each participant confirms they are physically and mentally fit to participate in an intensive 24-hour event and have no medical condition that would be aggravated by extended working hours, sleep deprivation, or a competitive environment.

2. Assumption of Risk

Participants acknowledge that a 24-hour event involves inherent risks including fatigue, physical discomfort, and the possibility of accidents or injury on the premises. Each participant voluntarily assumes all such risks.

3. Limitation of Liability

Ensylon India Private Limited, its directors, employees, and representatives shall not be held liable for any injury, illness, medical emergency, loss, theft, or damage to personal property occurring during or in connection with the Hackathon, including travel to and from the venue, except where such liability cannot be excluded under applicable Indian law.

4. Medical Emergency Consent

In the event that a participant becomes ill or injured and is unable to communicate, they authorise Ensylon staff to contact the emergency contact provided at registration and to seek appropriate medical assistance on their behalf. Any costs associated with medical treatment remain the sole responsibility of the participant.

5. Food and Allergies

Ensylon will provide refreshments and meals during the event. Participants are responsible for communicating dietary restrictions or food allergies via this registration form. Ensylon cannot guarantee a fully allergen-free environment and is not liable for any adverse reactions from food consumed at the event.

6. Personal Equipment

Participants are responsible for their own laptops, devices, and personal belongings. Ensylon is not liable for any loss, theft, or damage to personal equipment brought to the venue.

7. Right to Remove

Ensylon reserves the right to ask any participant to leave the premises if their behaviour is deemed unsafe, disruptive, or in violation of the event rules or applicable law, without any obligation to provide compensation or refund.

8. Event Modification or Cancellation

In the event of circumstances beyond Ensylon's reasonable control (including natural disaster, public health emergency, or government directive), Ensylon reserves the right to modify, postpone, or cancel the Hackathon. Ensylon will not be liable for costs incurred by participants as a result of such changes.
